OVERVIEW

This website is operated by Wesley’s Cocoa Farm. Throughout this website, the terms “Wesley’s,” “we,” “us,” and “our” refer to Wesley’s Cocoa Farm.

These Terms of Service govern your access to and use of CocoaFarm.com, including purchases, memberships, subscriptions, content, and other services offered through the website.

By visiting our website, creating an account, placing an order, purchasing a membership, or otherwise using our services, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, and Return and Refund Policy.

If you do not agree to these Terms, please do not use the website or purchase our products.

ELIGIBILITY AND ACCOUNTS

You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase through this website.

When creating an account or placing an order, you agree to provide current, complete, and accurate information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us promptly if you believe your account or payment information has been used without authorization.

PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to present our products, packaging, ingredients, photographs, descriptions, prices, and availability accurately. Because many of our products are handmade, agricultural, seasonal, or produced in small batches, reasonable variations may occur.

Natural cacao products may vary by harvest, origin, genetics, fermentation, drying, roasting, and other agricultural or production conditions. Flavor descriptions and tasting notes describe our experience of a product and are not guarantees that every person will perceive the same flavors.

Packaging, photographs, product details, ingredients, and availability may change as products evolve. Colors and appearances displayed on a screen may also vary from the physical product.

AVAILABILITY AND ORDER ACCEPTANCE

Products may be offered in limited quantities and may be discontinued or changed without notice.

Submitting an order does not guarantee acceptance. We may limit, reject, or cancel an order for legitimate business reasons, including:

Product or inventory errors
Incorrect prices or descriptions
Suspected fraud or unauthorized payment
Unusual quantities or apparent resale activity
Shipping restrictions
Inability to safely fulfill an order
Technical or administrative errors

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

PRICES, PAYMENT, AND TAXES

Prices are shown in U.S. dollars unless otherwise stated. Prices, promotions, and product availability may change without notice.

You agree to provide valid payment information and authorize us and our payment providers to charge the amounts shown during checkout, including applicable taxes, shipping charges, subscription charges, and other disclosed fees.

You are responsible for any taxes, duties, or charges imposed by your jurisdiction unless they are collected at checkout.

SHIPPING AND DELIVERY

Shipping estimates are not guaranteed delivery dates. Carrier delays, weather, extreme temperatures, holidays, address problems, and other circumstances outside our reasonable control may affect fulfillment or delivery.

Chocolate and certain other products are heat-sensitive. We may delay, pause, restrict, or reschedule shipments when temperatures or transit conditions could materially compromise product quality. Our typical warm-weather shipping pause may occur approximately between May 15 and October 1, but actual dates are determined at our discretion based on conditions.

Customers are responsible for providing a complete and accurate shipping address and for retrieving delivered packages promptly. Additional charges caused by an incorrect address, refused delivery, failed delivery, or failure to retrieve a package may be the customer’s responsibility.

RETURNS, REFUNDS, AND ORDER PROBLEMS

Because we sell food and other perishable or consumable products, we generally cannot accept returns of delivered food products.

If an order arrives damaged, melted, incorrect, incomplete, or otherwise materially compromised, please contact us promptly with your order number, a description of the problem, and photographs of the product and packaging when reasonably possible.

Depending on the circumstances, we may offer a replacement, store credit, refund, delayed replacement, or another reasonable resolution. We reserve the right to review claims and identify patterns of misuse or abuse.

Complete terms are provided in our Return and Refund Policy, which is incorporated into these Terms.

FOOD SAFETY, ALLERGENS, AND STORAGE

Please review ingredient statements, allergen disclosures, storage directions, and product-specific information before purchasing or consuming a product.

Our products may be produced in a kitchen or facility that handles common allergens. Cross-contact may be possible even when an allergen is not intentionally included in a particular recipe.

If you have a serious allergy, dietary restriction, medical condition, or uncertainty about a product, contact us before purchasing and consult an appropriate healthcare professional when necessary.

Customers are responsible for following storage and handling instructions after delivery.

COCOA PHARMA AND FUNCTIONAL PRODUCTS

Cocoa Pharma products may contain cacao, botanicals, nutrients, supplements, or other functional ingredients.

Information provided about these ingredients is for general educational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease.

Always read the complete product-specific Use and Safety Information before consuming a Cocoa Pharma product. Consult a qualified healthcare professional before use if you:

Are pregnant, planning to become pregnant, or breastfeeding
Are under 18
Have a medical condition
Take medications or other supplements
Have allergies or ingredient sensitivities
Have questions about whether a product is appropriate for you

Use products only as directed. Individual experiences and results may vary.

FLIGHT CLUB AND OTHER SUBSCRIPTIONS

Certain products or memberships, including Wesley’s Flight Club, may be offered on an automatically renewing basis.

By purchasing an auto-renewing membership or subscription, you authorize us and our payment provider to charge the payment method on file at the disclosed interval until automatic renewal is canceled.

FLIGHT CLUB

Unless otherwise disclosed when you enroll:

Flight Club is an annual membership.
Membership includes four seasonal Flight shipments during the paid membership term.
Each Flight typically contains five 30-gram chocolates.
Shipping within the contiguous United States is included.
Shipment windows are selected with chocolate quality and weather conditions in mind.
Exact shipment dates may change because of temperatures, carrier conditions, product readiness, or other operational considerations.
Guided tasting details and recordings are provided according to the schedule communicated for each Flight.
Some chocolates may be created specifically for a Flight or may not be offered separately. Exclusivity is not guaranteed for every chocolate or every Flight.

RENEWAL AND CANCELLATION

Your membership renews automatically at the price and frequency disclosed at enrollment unless you turn off automatic renewal before the renewal is processed.

You may manage or cancel automatic renewal through your customer account when that feature is available, or by contacting us at hello@cocoafarm.com.

Canceling automatic renewal prevents the next annual charge. It does not ordinarily end or prorate the membership term already purchased. You will continue receiving the remaining benefits and scheduled Flights included in your paid term.

We will provide renewal disclosures and notices as required by applicable law. Please keep the email address associated with your account current.

If membership pricing or material renewal terms change, we will provide advance notice when required before the new terms apply.

PROMOTIONS AND DISCOUNTS

Promotions, discount codes, gifts with purchase, and other offers may be subject to separate conditions. Unless expressly stated otherwise:

Offers cannot be redeemed for cash.
Offers may not be combined.
Offers may exclude certain products, memberships, subscriptions, shipping charges, or taxes.
Discounts cannot be applied retroactively.
We may correct, suspend, or withdraw an offer containing an error or being misused.

RECIPES AND EDUCATIONAL CONTENT

Recipes, preparation methods, tasting guidance, articles, and other educational materials are provided for general informational and inspirational purposes.

Cooking times, yields, temperatures, ingredient substitutions, and results may vary. You are responsible for safe food handling, checking allergens and dietary needs, and determining whether a recipe or preparation method is appropriate for you.

REVIEWS, COMMENTS, AND SUBMISSIONS

If you submit a review, photograph, comment, suggestion, recipe variation, testimonial, or other content, you represent that you have the right to share it and that it does not violate another person’s rights.

You grant Wesley’s Cocoa Farm a non-exclusive, royalty-free right to use, reproduce, edit, publish, and display submitted content in connection with our business and marketing, subject to applicable law and our Privacy Policy.

We may remove content that is unlawful, misleading, abusive, infringing, irrelevant, or otherwise inappropriate.

INTELLECTUAL PROPERTY

The website and its contents—including product names, designs, photographs, graphics, illustrations, recipes, editorial content, packaging, logos, trademarks, and written materials—are owned by or licensed to Wesley’s Cocoa Farm and are protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial purposes. You may not copy, reproduce, republish, sell, distribute, modify, scrape, or commercially exploit our content without prior written permission.

PROHIBITED USES

You may not use the website or services:

For an unlawful or fraudulent purpose
To violate another person’s rights
To transmit malicious code or interfere with website operation
To collect information about others without authorization
To impersonate another person or misrepresent your identity
To bypass security or purchasing restrictions
To misuse promotions, refunds, reviews, memberships, or customer accounts
To resell products without authorization where authorization is required

We may suspend access or cancel orders associated with prohibited conduct.

THIRD-PARTY SERVICES AND LINKS

Our store is hosted using Shopify and may use third-party services for payments, shipping, subscriptions, reviews, analytics, and other functions.

Third-party websites, applications, and services are governed by their own terms and privacy practices. We are not responsible for third-party content or conduct outside our reasonable control.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website, its content, and our services are provided on an “as available” basis without warranties not expressly provided by us.

We do not guarantee that the website will always be uninterrupted, error-free, or free of harmful components, or that product availability and delivery estimates will remain unchanged.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Wesley’s Cocoa Farm and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website, products, content, or services.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by law.

Nothing in these Terms limits liability or consumer rights that cannot lawfully be limited.

INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Wesley’s Cocoa Farm and its owners, employees, contractors, and service providers from claims, damages, or expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will remain in effect.

NO WAIVER

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

GOVERNING LAW

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute that may properly be heard in court will be brought in a court with jurisdiction over our principal place of business, unless applicable law requires otherwise.

CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our products, services, practices, or legal obligations.

The updated Terms will be posted on this page with a revised effective date. Changes apply after publication unless applicable law requires additional notice.

Your continued use of the website after an update constitutes acceptance of the revised Terms.
